Kagan questions free speech harm in same-sex wedding website

Supreme Court Justice Elena Kagan questioned on Dec. 5 how the petitioner would be harmed by designing a hypothetical website for a same-sex couple's wedding. Graphic designer Lorie Smith, represented by the same conservative legal organization that defended a Colorado baker in a similar 2018 case, has said that Colorado's public accommodation law that would prohibit her from discriminating against same-sex couples would violate her religious liberty and free-speech rights.
