Lamonte Brewer is wanted in connection with the shooting a juvenile who was playing "dart wars" with other teens in Anderson Township last week.

Brewer and Shalonda Mixon, the sister of Cincinnati Bengals' running back Joe Mixon, were indicted Thursday. Shalonda Mixon was arrested Thursday and is being held at the Hamilton County Justice Center.

What is Brewer charged with?

Brewer is accused of shooting a 16-year-old boy with an AK-47 style pistol on March 6 outside of Joe Mixon's home on Ayers Road. The teen was struck in the foot and suffered minor injuries.

Brewer is charged with felonious assault, tampering with evidence and having weapons under disability, which means it was illegal for Brewer to have a gun. Prosecutor Melissa Powers said he faces up to 20 years in prison if he is convicted on all charges.

In Ohio, it is unlawful for you to have a gun in these circumstances:

  • You are a fugitive from justice (meaning you have escaped or avoided arrest or prosecution), have been charged or convicted of a violent felony offense.

  • You have been charged or convicted of a felony drug offense that involved illegal drug possession, sale, distribution, or trafficking, you are dependent on drugs or are in danger of being dependent on drugs.

  • You are a chronic alcoholic, have either been determined by the court to be mentally incompetent, mentally defective, or mentally ill or have been ordered by the court to live at a mental health institution.

  • Under Ohio’s law on having weapons while under disability, if you possess, acquire, carry or use a firearm or dangerous ordnance in the above circumstances, than this constitutes a third-degree felony which is punishable by a maximum five-year prison sentence and $10,000 fine.

Brewer's background

Powers said Brewer had a "lengthy" criminal record including drug and violent offenses.

Court documents state he was convicted of two felonies in Alameda County, California. San Francisco is in Alameda County.

Brewer was convicted of assault with a firearm in a 2008 case and sentenced to four years in prison, according to court documents. He was also convicted of purchasing or possessing cocaine base for sale in 2011, records show.

Prosecutors cited these cases as the reason why Brewer could not have a gun in Ohio.

Public records show Brewer has previously lived in San Pablo and Richmond in California.

What is "dart wars"?

Dart wars or Nerf wars has been played by area high schoolers for more than 20 years. The game involves pairs of teams that face off in a bracket-style elimination. The teams try to shoot opponents with foam darts to earn points.

The teenager who was shot was a student at Anderson High School, the school confirmed. David Spencer, the principal of Turpin High School, another Forest Hills high school, issued a warning to parents and students about the game in February.

"Many of the Nerf guns and homemade devices resemble a real gun to a person seeing (them) from afar," Spencer said. "In the world we live in today, that may cause extreme concern and a certain reaction that was unintended by our young adults."

Following the shooting, the student-organized game at Anderson High School was halted.

Powers said she believes it would have been easy to tell that the juveniles were using toy guns the night of the shooting.

Joe Mixon was not implicated in the shooting

Powers said Mixon was armed and with Brewer either at the time of the shooting or just before, but video shows he did not fire any shots and legally possessed the weapon.

"Mixon claims to have been receiving death threats and was concerned for his safety after his sister telling him there were people outside with guns," Powers said. "As a legal gun owner, Mixon had the right to possess the firearm and did not commit a crime."

The NFL Network reported Joe Mixon's lawyer, Peter Schaffer, issued a statement following the indictment.

"Joe hates that a young adult was injured during this incident. He has been involved in youth activities in various capacities since joining the Bengals and calling Cincinnati home. His goal has always been to help our youth, not harm them," the statement reads.
