Gardner is being held on a fugitive warrant in Benton County, Wash., and no extradition date has been set. The judge there said she has the right to require Florida to secure a governor's order for her return to Duval County. A prosecutor said he has been in contact with the State Attorney's Office in Jacksonville and expects it to obtain a governor's warrant.

Gardner's attorney, Andrew Wagley, said they do not anticipate waiving extradition and will look into the writ of habeas corpus procedure challenging the constitutionality of her detention. The judge set a review hearing for Sept. 14. The state can hold her up to 90 days.
