Kourtney Kardashian‘s ex-boyfriend is finally making moves to deal with a lawsuit accusing him of assaulting a security guard at Coachella.

According to court documents obtained by The Blast, Younes Bendjima made his first appearance in the lawsuit filed by a security guard accusing him of battery in front of Kourtney K.

The model reached a deal with the man suing him to vacate a default that had been entered against the model in the case, which is the first step to obtaining a default judgment.

Bendjima claims that despite the man claiming to have served him with the lawsuit, he never received the papers. As a result, he will now have 30 days to file his answer to the case.

Last year, Mario Herrera sued Bendjima, claiming he tried to enter a bathroom with his then-girlfriend Kourtney at the 2018 Coachella Valley Music and Arts Festival.

Herrera was working as a security guard and told Benjima he couldn’t go into the single-gender bathroom with Kourtney. He claimed this caused the model to become enraged and he lifted him up and slammed him against a wall.

The guard sued seeking $5 million for damages and the alleged injuries he had to be treated for at the hospital.
