Donald Trump's second impeachment trial kicked off Tuesday in Washington, D.C., with a debate over whether it's even constitutional to prosecute a former president. The Senate voted 56-44 to proceed, with six Republicans joining Democrats who supported moving forward with the trial.

Earlier, House prosecutors opened with a powerful video montage that tied Trump’s rhetoric to the deadly Jan. 6 assault on the U.S. Capitol. Trump’s lawyers argued that it was political speech protected by the First Amendment.

Senate lawmakers will ultimately decide whether to convict or acquit Trump on the charge that he incited the riot.
