Local contractor fined $11k for deceptive business practices

WICHITA, Kan. (KSNW) — Following a consumer complaint, the Sedgwick County District Attorney’s Office entered an $11,087 judgment against a local contractor.

A news release from the DA’s office said Justin Henry, doing business as JH Industries, received a complaint of a customer who said Henry failed to deliver the fence panels she paid for in advance also failed to provide a promised refund.

Henry did not respond to a request for comment by KSN. We attempted to contact with a phone call, which was not answered and the voicemail box said it was full.

The DA’s Office said in the news release the Consumer Protection Division tried to resolve the matter prior to litigation by demanding a full refund after he failed to provide evidence he performed uncompensated work for the customer.

Legal action followed after Henry failed to respond to the demand.

The DA’s Office said the court found Henry’s failures to be “deceptive” and/or “unconscionable.” The court ordered Henry to pay $390 in restitution to the customer, $10,000 in civil penalties as well as court costs and investigation fees.

Henry was ordered to refrain from engaging in consumer transactions in the state of Kansas until the money is paid.
