Man accused of ransacking Doña Ana Chucky's convenience store granted bond

LAS CRUCES - A man accused of ransacking a convenience store was granted bond Friday by District Judge Richard Jacquez at a hearing in 3rd Judicial District Court.

The District Attorney’s office filed a motion requesting defendant Elee Garcia Silva, 43, to be held without bond pending trial on charges of criminal damage to property (greater than $1,000), criminal damage to property (less than $1,000), aggravated battery (great bodily harm), battery and cruelty to animals. Jacquez's ruling stated that there are conditions of release that would reasonably protect the community. He issued a $10,000 secured bond, curfew and other conditions of release that must be adhered to.

Silva is accused of entering Chucky’s Convenience Store on E. Thorpe Road in Doña Ana on Wednesday, May 11. Authorities say he began shouting for the clerk to call the owner of the store. At the time the clerk was pricing a box of liquor bottles, Silva then reached in and began to throw the bottles of liquor at the clerk, authorities say. She was struck 3 times, according to court documents. Video shows the clerk running out of the store and Silva ransacking the property inside.

When Silva exited the store, he is alleged to have approached an elderly man that was putting gas in his truck. Video of the incident appears to show Silva pounding on the truck, then opening the passenger side door, reaching in and grabbing the owner's small dog from the seat and flinging the dog into the parking lot — approximately 10 feet.

Silva appears to strike the man, and when he fell to the ground, proceeded to kick him, authorities say. Bystanders who witnessed the affray came to the aid of the elderly man, chasing Silva away, according to court documents. The man who was beaten was taken to an area hospital for treatment, according to authorities.
