Man acquitted in 2022 fatal shooting of 19-year-old on North Gray Street

Update: A jury on Aug. 9, 2023 found David Villanueva not guilty of his charges in the fatal shooting of a 19-year-old in 2022. Villanueva was released from custody.

Indianapolis police on Wednesday arrested a man in the killing of a 19-year-old in a neighborhood on the city's east side.

David Villanueva, 19, was arrested on a preliminary charge of murder in the fatal shooting of Tyvon Moore that occurred Monday morning on North Gray Street, near East Washington and North Rural streets.

A preliminary probable cause affidavit shows the shooting stemmed from a short argument between the men as they left the east-side home. Witnesses told police the two men “had words” near the front door of the house. They said Moore pushed Villanueva as they were on their way outside. Villanueva then pulled a gun from his waistband, shot Moore in the head, ran to his car and drove away on Gray Street, the affidavit said.

Another person at the house said a man, who she later identified as Villanueva, pointed a gun at her before he got into his car.

Indianapolis detectives in court records noted glass from the front door lay shattered on the ground outside the house.

Police found Villanueva was listed in a police report in Greenwood. A police sergeant found Villanueva’s blue Dodge Charger parked in front of apartments, the affidavit said. Officers later saw Villanueva walk out of the complex’s common door with a handgun and walk toward a car.

Investigators in the affidavit said as officers approached Villanueva to put him in custody, he threw the gun under the car.

When questioned by police at the department, Villanueva asked for an attorney, the affidavit said.
