The North Dakota man who was recently found guilty of three felonies for shooting two officers in Delafield has been charged again in Waukesha County. This time, he's accused of biting a bailiff.

According to criminal complaints, Nathanael Benton, 25, was being transported to a courtroom by two bailiffs in the Waukesha County Courthouse on June 6, the first day of his trial for shooting the two officers. At about 7:45 a.m., the victim advised Benton that jewelry he had fashioned needed to be removed from his ears before he went to court.

Benton refused to take the jewelry out, the complaint said. A bailiff reached to remove the jewelry, and Benton reportedly grabbed the victim's right arm and hand and bit his hand. Puncture marks were seen on his hand after the incident, according to the complaint.

The victim reportedly struck Benton in the head to get away from him. Benton continued to kick and strike the bailiff's left leg after they were separated, the complaint said.

Benton faces one felony count of battery by a prisoner in connection with the incident. He is scheduled to be in court next on June 17 for a hearing on the latest charge.

This is the second time Benton has been charged while in custody in Waukesha County. Benton also faces three felony charges of attempted first-degree intentional homicide, throwing bodily substances, battery by prisoners, and a misdemeanor for disorderly conduct. He is accused of stabbing and assaulting another inmate in December 2021. A jury trial is scheduled for July 26-28 in that case.

He was convicted June 9 of shooting two police officers in Delafield in November 2020. He could face up to 78.5 years in prison in connection with those charges; his sentencing is scheduled for Aug. 29.
