Man faces first-degree murder charge after shooting at Riviera Beach gas station leaves 1 dead

RIVIERA BEACH — A 29-year-old Riviera Beach man is facing a first-degree murder charge in connection to a fatal shooting this month in a gas station parking lot.

Deandre Shawn Burgess also faces a charge of being a felon in possession of a firearm in the killing of a 31-year-old Riviera Beach man on the night of May 3. The shooting took place along the 400 block of President Barack Obama Highway, just north of the West Palm Beach city limits.

City police did not disclose the name of the man who died, citing a 2018 state constitutional amendment that allows either crime victims or their families to request that their names be withheld from public reports.

Burgess refused to appear Wednesday for a hearing at the Palm Beach County Jail. Circuit Judge Kirk Volker assigned Burgess a public defender and ordered that he be held without bail on the murder the charge. As a policy, the public defender's office does not comment on open cases.

West Palm police have not identified motive for shooting

An arrest report made public Wednesday did not indicate a motive for the shooting. The report states that surveillance-camera video showed the 31-year-old arrive at the gas station in a van and speak to another person.

The man got out of the vehicle and began walking to the gas station convenience store when he stopped between two gas pumps.

A man identified as Burgess is then seen pulling out a handgun and firing several shots, according to the arrest report. A ShotSpotter alert indicated that the 10 rounds were fired. Additional surveillance footage showed Burgess arriving at the gas station in a gray a Hyundai.

U.S. Marshals, West Palm police helped in arrest

Later, a woman who rented the vehicle told investigators she dropped Burgess off at the gas station, the report said.

Police also contacted a Palm Beach County Sheriff's Office tactical agent and a probation officer connected to other cases involving Burgess, according to the report. They confirmed his identity.

Investigators took Burgess into custody Tuesday after the U.S. Marshals Fugitive Task Force apprehended him with the help of the West Palm Beach Police Department Strategic Investigations Division.
