Houma man pleads guilty to 5 counts of possession of child pornography

A New Orleans man was sentenced to eight years in prison in Assumption Parish after pleading guilty to his fourth DWI.

Charles Burbank, 38, also pleaded guilty to driving with a suspended license and driving without a vehicle registration, prosecutors said.

After Burbank entered his pleas last week, state District Judge Alvin Turner Jr. handed down the eight-year sentence with credit for time served. The maximum penalty for a fourth DWI in Louisiana is 30 years in prison.

Prosecutors said the plea resulted from a traffic stop two years ago in Pierre Part. State Police responded March 14, 2020, to investigate a possible impaired driver later identified as Burbank, prosecutors said.

“Upon making contact with Burbank, the trooper detected the odor of an alcoholic beverage emitting from Burbank’s breath,” prosecutors said. “Burbank admitted to consuming alcohol hours before being stopped. Burbank submitted to a series of standardized field of sobriety tests which he performed poorly on.”

Burbank was taken to the Assumption Parish jail, where he submitted to a breath test that showed a blood-alcohol level of .157%, nearly twice the legal limit, officials said. He was then booked into the jail, where he was held without bail.

Assistant District Attorney Lana Chaney prosecuted the case.
