Man pleads guilty to murder of Kristian Rose, sentenced to 25 years

The fourth suspect involved in the killing of Kristian Rose in 2019 has pleaded guilty and sentenced to 25 years in prison, according to court documents released this week.

On April 2, 2019, the San Angelo Police Department responded to the 600 block of E. 39th Street in San Angelo for reports of a shooting victim.

Responding officers found Kristian Rose suffering from a gunshot wound. Shortly thereafter, Rose succumbed to his injuries at the scene.

"The victim’s mother, Sandra Rose, told police that she heard a gunshot, ran outside her house, and encountered two males in the process of attacking her son," the documents stated. "According to Ms. Rose, the males were dressed in black and wearing face masks. While one of the males threatened to shoot Ms. Rose if she didn’t back off, the other male tazed Kristian while he was on the ground screaming for help."

As the mother called 911, the two males fled in a vehicle.

"Through extensive investigation, SAPD Detectives were able to determine that the two males encountered by Ms. Rose were Brian Ray Garcia and Jacob Daniel Martinez."

The two were accompanied by Alexis Taylor Jackson and Joshua Derek Jaquez.

"Detectives learned that the group targeted Kristian because Jackson was angry that Kristian had allegedly threatened her the previous day with a pistol," the documents stated. "Jaquez was determined to be the getaway driver of the vehicle used by Garcia, Martinez and Jackson after Kristian was shot."

On June 5, 2019, a Tom Green County Grand Jury returned indictments charging all four co-defendants with murder in Rose's killing.

Garcia and Martinez were arrested on April 18, 2019, during an incident in which they were attempting to intimidate a witness associated with the investigation.

On Feb. 14, 2022, Garcia was sentenced to 50 years in the penitentiary for murder. Garcia was also sentenced to 25 years confinement for possession, with intent to deliver, a controlled substance, and unlawful possession of a firearm. Lastly, Garcia was sentenced to 10 years confinement for Assault on a Public Servant for an incident involving a Tom Green County jailer.

On June 2, 2022, Martinez was sentenced to 35 years in the penitentiary for murder. Martinez was also sentenced to 20 years confinement in which his felony probation for Burglary of a Habitation was revoked. Martinez was also sentence to 10 years confinement for Attempted Burglary of a Habitation and Possession of a Prohibited Weapon in association with events arising out of his arrest on April 18, 2019.

Jackson was arrested on May 2, 2019, in Tom Green County. On December 8, 2022, Jackson pled guilty to murder before visiting Judge Ernie Armstrong with no recommendation from the State regarding her punishment. In exchange for her cooperation in the case, the State agreed to cap her maximum sentence at a possible 35 years. After hearing evidence, Judge Armstrong sentenced Jackson to 35 years in the penitentiary.

Jaquez was arrested on May 1, 2019, in Pecos County. On March 23, 2023, Joshua Jaquez pled guilty to murder before Judge Carmen Dusek with no recommendation from the State regarding his punishment. In exchange for his cooperation in the case, and his testimony in the trial of Alexis Jackson, the State agreed to cap his maximum sentence at a possible 25 years. After hearing evidence, Judge Dusek sentenced Jaquez to 25 years in the penitentiary.

John Best, 119th District Attorney, said the murder of Rose resulted from a senseless act of violence.

"The lengthy sentences for each defendant will ensure that those involved in Kristian’s death will not play a role in further violence within our community for many years," he said. "Although no amount of time served in the penitentiary by the defendants in this case will bring Kristian Rose back to his family and friends, I am hopeful that the final resolution of these cases provides those who cared about Kristian with a sense of closure and justice."

Best thanked the San Angelo Police Department and especially Detectives Lyn Dye, Adrian Castro,and Matthew Hawthorne, for their hard work investigating this case and identifying those involved.

"Without the hard work and sacrifice of our law-enforcement community, we could not bring violentcriminals to justice," he said. "I also want to thank Sandra and Donald Rose for their strength and patience asour office worked toward resolving these cases."
