Manchester Twp. zoning board to hear challenges on rezoned parcels near Prospect Hill

The Manchester Township Zoning Hearing Board will hear testimony challenging the validity of several rezoned parcels.

The challenge, brought by Prospect Hill Cemetery owner Matt Seyler, is for ordinances 2023-01 and 2021-11. These ordinances rezoned parcels at 180 Willis Run Road, 700 North George Street, 1201 Pennsylvania Avenue and Willis Road from Low Density Residential District to the Industrial District. One of these parcels is owned by Met-Ed.

The basis of the challenge, according to Seyler, is that the rezoning is an example of spot zoning, or zoning specific parcels of land within a larger area when the rezoning is at odds with a township's or city's master plan. Spot zoning is often illegal when it favors a landowner or developer.

Seyler alleges that this rezoning does not fit with the township's plan and the rezoning classification does not fit with the surrounding parcels, thereby making it a case of spot zoning.

These parcels are near the cemetery, and the rezoning has opened the door for a large warehouse or other industrial property to be built next to the cemetery.

The board will hear testimony about this challenge at 6 p.m., Oct. 4, at the Alert Fire Co. hall, 3118 N. George St., Emigsville.
