Marco Perez found guilty of capital murder in shooting death of Mobile Police officer

MOBILE, Ala. (WKRG) — Marco Perez, the man accused of shooting and killing undercover Mobile Police officer Sean Tuder in 2019, has been found guilty of his murder.

Perez was 19 at the time of the shooting that took place at Peach Place Inn. Surveillance video that played during opening statements showed Officer Tuder working undercover pulling up to the apartments on Leroy Stevens Road in West Mobile.

The video shows Tuder getting out of his car and pointing a gun at Perez. They both began wrestling, and in the video, their altercation went off-camera, and that’s when Prosecutor Ashley Rich said Perez fired three shots at Tuder.

Both the state and the defense made their closing arguments on Tuesday.

The state argued Perez knew who Tuder was at the time of the murder, and Tuder was in fact on duty with his badge on and had permission to be when he went to apprehend Perez on Jan. 20, 2019.

The defense argued Perez killed Tuder in self-defense as he did not know who Tuder was, and he did not know he was under arrest.

“If that’s not self-defense, then there is no self-defense,” Criminal Defense Attorney Dennis Knizley said.

The defense closed their argument saying the state did not prove capital murder in this case.
