Montgomery County Detectives allege Moore broke into the apartment through a window on Walnut Street on Sunday night.

Moore used to live there with his ex-girlfriend, but he moved out several months earlier after ongoing domestic issues, charging documents state.

When his ex arrived at the home, Moore struck her multiple times, and threatened her and whomever she was currently dating, according to court documents. She went to sleep, and Moore stayed until the next morning, when she told him he was not allowed in the apartment anymore, police said.

Moore began shooting a handgun at Smith, who returned fire with his own handgun, police said. Smith was killed in the shooting, and Moore was injured.
