Milton man indicted on first-degree murder charge in July shooting

DEDHAM – A Norfolk County grand jury has indicted a Milton man on charges of first-degree murder in the shooting death of Marquis Simmons in July.

The suspect, Myles King, had been charged with murder in Quincy District Court two days after the fatal shooting of Simmons, 25, of Milton, on July 10. King was indicted by the grand jury in Superior Court on Nov. 19.

Bryanna Gardener was indicted in relation to the case on a charge of being an accessory after murder.

Gardener was in a relationship with King, Norfolk County district attorney's office spokesman David Traub said in a news release. She will be issued a summons to appear for her arraignment. No arraignment dates have been set for King or Gardener.

Prosecutor Adam Lally said during the July arraignment that Simmons identified the man who shot him in the upper chest on Belvoir Road as "Mizzie Cash," a name police linked to King through his Instagram account and YouTube videos.

Prosecutors said Simmons was riding his moped on Belvoir Road at 6 p.m. July 10. He had stopped and gotten off the moped when he was shot in the upper chest from a few yards away.

State Police Detective Michael Proctor said in an arrest warrant affidavit that a witness said he heard two "pops." The witness said he then saw two men running down Belvoir Road, then turn right onto Blue Hills Parkway. Both were wearing tracksuits, one red and the other green or blue. The witness took off his shirt and applied pressure to Simmons' wound before police arrived.

A different witness said she heard two shots and saw a black Mercedes with Maine plates leaving the area, Proctor said in court documents.

Surveillance cameras from the area show a black Mercedes with Maine plates driven erratically on Blue Hills Parkway near Belvoir Road. An officer headed to the scene said he saw a car fitting the same description in King's driveway on Decker Street.

A detective arrived at the scene a few minutes later, and said he saw a woman putting a Massachusetts license plate on the sedan. Once the detective realized a black Mercedes was likely involved, he went back but wasn't able to find it, Lally said during the July arraignment.

In a separate case, a grand jury on Nov. 17 indicted King on charges of carrying a firearm without a license, carrying a loaded firearm without a license, possession of a large-capacity firearm, receiving a stolen vehicle and using a firearm in a felony.

In that case, on April 4, 2019, officers said they checked the license plate of the car in which King was sitting, which was parked in front of Simmons' house, and learned it was reported stolen. King then told officers there was a pistol under his seat, which officers said was cocked, authorities said.
