Muncie man charged in triple killing to await trial in prison

MUNCIE, Ind. — A Muncie man accused of killing three members of a local family will await his trial in a state prison rather than the Delaware County jail.

Devin Xavier Myers, 28, in recent days was transferred from the jail to the Pendleton Correctional Facility in Madison County.

Myers is charged with three counts of murder, in the July 12 shooting death of 19-year-old Kyler Ryan Musick, and the July 13 slayings of Musick's grandfather and great-aunt, Malcolm Perdue and Kyndra K. Swift.

The later two homicides took place during an armed home invasion of the South Liberty Street home where Musick's family lived. Along with the murder counts, Myers faces additional charges, including armed robbery, criminal confinement and obstruction of justice.

On Aug. 11, corrections officers at the jail reported a "shank" had been found in Myers' possession, and also said he had threatened to kill jailers.

That prompted Delaware County Prosecutor Eric Hoffman to file four more charges against Myers, being a prisoner possessing a deadly weapon, criminal mischief and two counts of intimidation.

Myers' trial, on all 14 charges against him, is set to begin on Jan. 2 in Delaware Circuit Court 5.

(Myers' mother also recently contacted The Star Press and said her son was not being given reasonable access to a telephone in the jail.)

Court records reflect Myers was recently "moved out of the Delaware County jail to (the) Pendleton Correctional Facility... due to officer safety."

Myers was released from prison this year after being granted parole. Since 2014, he had been serving a prison term stemming from an armed robbery conviction in Delaware County.

According to a state Department of Correction website, Myers' parole in that case has been revoked, and he is now scheduled to remain in state custody through Dec. 23, 2024.

Any convictions resulting from the charges now pending in Delaware County could extend his stay in prison, obviously.
