Musk under federal probe tied to deal: Twitter filing

STORY: Elon Musk is being investigated by federal authorities over his conduct in his $44-billion takeover deal for Twitter.

That’s according to the social media company in a court filing made public on Thursday.

Though it did not give details on the focus of the probes, or which federal authorities are conducting them.

Twitter said attorneys for Musk had claimed what they called "investigative privilege" in refusing to hand over documents it was seeking, when suing the Tesla CEO in July to push forward the takeover.

It said, in late September, Musk's attorneys had provided a "privilege log" identifying documents to be withheld.

The log referenced drafts of an email to the U.S. Securities and Exchange Commission, or SEC, and a presentation to the Federal Trade Commission, or FTC.

In the newly released court filing, the company said, "This game of 'hide the ball' must end."

The document was filed on October 6, asking the Delaware judge overseeing the case to order Musk's attorneys to provide the requested materials.

On the same day, the judge paused litigation between the two sides, after Musk reversed course and said he would proceed with the deal.

Alex Spiro, an attorney for Musk, told Reuters that Twitter's court filing was a "misdirection" and asserted "It is Twitter's executives that are under federal investigation."

Twitter and the FTC declined to comment, while the SEC did not immediately respond to Reuters’ request for comment.
