Admission on police application leads to sexual assault indictment

A man who applied to the Wichita Falls Police Department Training Academy has been indicted on a charge of sexually assaulting a 13-year-old girl, according to court documents.

Diego Abram McCullough, 26, was indicted on a charge of aggravated sexual assault of a child by a Wichita County grand jury on June 26. The first degree felony is punishable by up to life in prison in case of a conviction.

McCullough was free Monday on $50,000 bail, according to court documents.

Anyone charged with a crime is presumed innocent until proven guilty in a court of law.

The allegation came to light in June 2023 when McCullough filled out his application for the academy.

A criminal history questionnaire in it asked whether the applicant has performed sexual acts after turning 17 with someone younger than 17.

McCullough replied, yes, according to allegations in affidavits filed in the case. During an interview about his application, McCullough said when he was 20 or 21 years old in October 2018 he met a female online who he suspected might be underage.

He said she refused to show him an ID, but he had sex with her anyway, according to allegations in affidavits.

Police interviewed the victim, who confirmed the incident happened at McCullough’s house on Keeler Avenue. According to the affidavit, she also picked McCullough out of a photo line-up, and he was listed in her phone contacts.

McCullough was arrested at his job at United Regional Health Care System on Sept. 7, 2023, and was released on $50,000 bail the following day, according to online jail and court records.
