Armed Davenport man faces charges, tickets after traffic incident

An armed 39-year-old Davenport man was released on bond after police allege he drove recklessly Friday afternoon in Davenport, according to court records.

Court records show Justin Wallace faces serious misdemeanor charges of operating while intoxicated – first offense, and person ineligible to carry dangerous weapons; and was ticketed for failure to provide proof of financial liability, reckless driving and improper lane usage.

Arrest affidavits say that shortly before 5 p.m. Friday, Davenport Police responded to the area of West Kimberly Road and Marquette Street for a report of a reckless driver.

An off-duty officer saw a maroon 2006 Chrysler PT Cruiser swerving all over the roadway, almost striking a pedestrian, according to affidavits.

The car was about to turn east onto Kimberly Road from Marquette Street and “abruptly cut through multiple lanes of traffic to turn westbound onto Kimberly Road,” affidavits say.

In affidavits, officers say they were able to block the vehicle in the 3900 block of Sturdevant Street. Wallace, who was the only person in the car, “could not provide proof of financial liability when asked.”

Police allege Wallace had bloodshot, watery eyes; had the smell of alcohol on his breath; had slurred speech; lacked balance; and was highly emotional, according to affidavits.

Wallace “reached for his waistband where a Springfield Arms Hellcat Pro handgun was observed by officers in a holster in (Wallace’s) appendix region,” according to affidavits, which show “The weapon was promptly secured by officers.”

Wallace admitted to “having a couple drinks” but would not specify what he drank. At 5:10 p.m., Wallace consented to a preliminary breath test and provided a test sample of .274 blood alcohol content. The legal limit is .08 percent.

Wallace is set for a preliminary hearing Aug. 6 in Scott County Court.
