Indy man found guilty of battery with a deadly weapon

Jul. 29—ANDERSON — An Indianapolis man is scheduled to be sentenced on charges of battery with a deadly weapon and being a serious violent felon in possession of a firearm.

Kenneth Horton Sr., 50, entered into a plea agreement in Madison Circuit Court Division 3 on July 18. Judge Andrew Hopper set sentencing for Aug. 7.

He is facing a possible prison sentence of three to 16 years on the battery charge.

According to a probable cause affidavit, Horton drove from Gary to assist a local man in the remodeling of a house on Ringwood Way on Nov. 9, 2023.

After Horton helped remove a wall in the house, he accused the man of contacting his wife.

Horton then demanded $5,000 and displayed a gun. According to the court document Horton fired the gun at the man's head and then fired a second shot that hit the man in the hip.

Horton walked away from the scene and police later stopped the car he was riding in.

The man at first didn't realize he had been shot, but was taken to an Indianapolis hospital where he was treated for a gunshot wound to the right pelvis and bladder.

Horton is a registered sex offender following a conviction earlier this year in Marion County on a rape charge. There was an outstanding warrant for his arrest at the time of the incident.
