SANTA FE, N.M. (KRQE) – The special prosecutor in the Rust shooting cause says Hannah Gutierrez, convicted for her role in the deadly shooting, should not be released as she continues her legal challenge. Gutierrez is serving an 18-month sentence for involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins.

Gutierrez’s lawyer says she should get a new trial or have her case dismissed after the surprise dismissal in the Alec Baldwin trial. He also filed a motion asking for her release during that process. In response, Special Prosecutor Kari Morrissey says that is premature considering the court has not taken up the motion for a new trial.
