Woman faces capital murder charge in 3-month-old daughter’s death
AUSTIN (KXAN) — A woman is now facing a capital murder charge in the March death of her 3-month-old child, a newly filed affidavit states.
The infant’s father is facing an injury to a child charge after “failing to intervene” for the 3-month-old victim and a twin sibling, who was also allegedly injured by the mother, the affidavit said.

On March 10, officers responded to a call for an infant who wasn’t breathing at a central Austin apartment complex, APD previously said. The child was taken to the hospital for their injuries and died five days later on March 15, police said.
A Travis County medical examiner determined on Oct. 4 the child’s death was a homicide, the affidavit states.
In March, police said detectives arrested 31-year-old Brittney Alisha Bailey with injury to a child, a first-degree felony, after noticing the infant’s twin sister appeared to have “non-accidental injuries.”
Bailey was booked into the Travis County correctional complex in May. Her bond is $600,000. The father, Erick Resendiz, 26, was charged with injury to a child, a state jail felony, and was booked Friday, Oct. 25. His bond is $10,000, records state.
Bailey’s attorney didn’t have a comment on the capital murder charge.
Attorney information for Resendiz is unavailable, as of Monday afternoon. KXAN will reach out for a statement when that information becomes available.
