'No one wins': Man acquitted in deadly shooting that lawyer says was self defense

A man accused in the 2022 fatal shooting of a 19-year-old on Indianapolis’ east side has been found not guilty of all charges.

David Villanueva, of Greenwood, had been charged with murder and two counts of pointing a firearm in the killing of 19-year-old Tyvon Moore, who died after being shot in the head on April 25, 2022. A jury acquitted Villaneuva of all counts.

A police report originally said an argument between two men at the front door of a home on North Gray Street preceded the shooting, with witnesses implicating Villanueva as the one who pulled the trigger. Investigators said a few people near the residence at the time told them when the gunfire erupted, the shooter pointed the gun at two people as he fled, got into a Dodge Charger and drove away.

When brought in by detectives for interviews about the shooting, Villanueva declined to talk further and asked for an attorney.

Villanueva's attorney, Katherine Jackson-Lindsay, said the case was revealed to be a matter of self-defense, with Villanueva having been pushed through a glass door at the home and then approached by the victim and another man likely carrying a knife.

Jackson-Lindsay said Villanueva fired a shot and ran.

"This is a sad situation here. No one wins," Jackson-Lindsay said. "It's not a happy ending for anyone and my client has to continue to live with the fact that he had to take a life to save his own life and he's not happy about that."

IndyStar has reached out to the Marion County Prosecutor’s Office but did not receive a response at time of publication.

The case was one of a handful highlighted last year by officials from the prosecutor’s office, lauding witness cooperation as a reason for the office’s ability to bring them to the courts.
