North Dakota man accused of firing gun at occupied residence
Oct. 23—WALSH COUNTY, N.D. — A North Dakota man is facing felony charges for allegedly firing a gun at an occupied residence on Saturday, Oct. 21.
George J. Tibert, 75, of Pisek, is charged with three counts of Class C felony reckless endangerment. Each count has a maximum penalty of five years in prison and $10,000 in fines.
Law enforcement was dispatched to a rural Lankin residence for shots fired at 7:29 p.m. Saturday, according to an affidavit in the case.
Law enforcement spoke with people inside the residence who were visibly shaking, wouldn't turn on the lights, and ducked into the hallway any time a vehicle drove past, the affidavit said.
They reported that a silver car drove past the residence and then, a few minutes later, drove past from the other direction. While driving by, a person inside the vehicle began shooting at the residence, then left the scene, the affidavit said.
Four bullet holes were observed in the exterior of the residence. Two of those bullets entered the residence, including one that went through the living room window, within 1 foot of where someone was standing, the affidavit said.
Another person, sitting on the living room floor, was struck by glass from the window. The third person inside the residence had been upstairs, where another bullet came through, the affidavit said.
Five empty shell casings were found on the road across from the residence.
Law enforcement located Tibert and found empty shell casings inside his vehicle that appeared similar to the shell casings found on the road.
A deputy had been at Tibert's residence approximately seven minutes prior to the report of shots fired, following up on a separate case, and he was not there.
Tibert denied any allegations. He was detained and taken to the Law Enforcement Center in Grafton.
During a hearing on Monday morning, Oct. 23, the state requested that Tibert undergo a psychological evaluation and risk assessment before being granted bond. This request was made based on the allegations as well as conversations Tibert had with law enforcement. The request was approved.
