Passaic County settles claim with woman hurt due to flooded sidewalk for $50,000

Passaic County commissioners Tuesday approved a $50,000 settlement with a Woodland Park woman who said a flooded sidewalk forced her to walk in a county-managed roadway before a car accident in an early 2019.

In September an arbitrator found the county partially liable for the woman's injuries due to insufficient drainage along McBride Avenue near the Interstate 80 overpass.

The woman, then 51, was struck at about 9 p.m. by a vehicle driven by a 17-year-old from Totowa, court records show. Police then said she was walking in the street to avoid a flooded sidewalk caused by severe rainstorms.

She suffered multiple fractures to her pelvis, left leg and left arm and was hospitalized for several weeks, court records show.

The arbitrator also found the state of New Jersey partially liable due to the road conditions and the woman liable for walking on the wrong side of the road at night in the rain and not looking back to check for approaching vehicles, court records show.

Police at the time of the accident said the woman was wearing dark clothing and the 17-year-old driver did not see her.
