Pensacola dentist Charles Stamitoles arrested after violating pre-trial release agreement

The Pensacola dentist convicted of battery for inappropriately touching an employee was arrested Wednesday morning for violating his pre-trial release agreement.

Charles Stamitoles, 65, was brought back to the Escambia County Jail after he traveled to Mobile, Alabama, which violates his bond agreement while he awaits three more battery cases.

"The defendant has failed to comply with the Pre-Trial Release Agreement for monitoring by Pre-Trial Services ... by failing to comply with special condition number eight, in that the defendant will not be permitted to leave Escambia, Santa Rosa or Okaloosa counties..." court records state.

The only exception is to allow Stamitoles to travel to Tallahassee to meet his attorneys who are representing him during his conviction appeal.

Gene Mitchell, Stamitoles's attorney, submitted a document to Judge Kristina Lightel stating Stamitoles had an emergency in Mobile.

"Evidently, Dr. Stamitoles had an urgent situation which required him to rush to Mobile on Sunday," the court document stated, "so he went to his Pretrial Release Office to attempt to get their permission and found the place to be closed."

Stamitoles was found guilty of misdemeanor battery Oct. 26 of last year for slapping an employee's buttocks, kissing her neck and grabbing her from behind without her consent. Lightel sentenced Stamitoles to 270 days incarceration in Escambia County Jail, but granted a motion for him to be released on $5,000 bond pending his appeal.

"If (Stamitoles) sits in jail for 270 days, we all know that the appeal is going to take longer than that," Mitchell told the judge during the hearing. "If he prevails on appeal, he will effectively be denied right to appeal since his punishment will have already been served."

Multiple women, both employees and patients, have accused Stamitoles of touching them inappropriately. The allegations resulted in Florida Surgeon General Joseph Ladapo ordering an emergency restriction on Stamitoles' license in June 2022 preventing him from practicing dentistry on women.
