Police: Mifflinburg man accused of rape exposed himself to two state troopers

Nov. 16—LEWISBURG — A Mifflinburg man already facing charges of rape allegedly exposed himself to two state troopers while being held on suspicion of driving under the influence, according to state police at Milton.

Nyahuma Spivey, 52, of Walnut Street, Mifflinburg, was charged with seven misdemeanors: three counts of DUI, one count each of indecent exposure, disorderly conduct, drug possession, and possession of marijuana; and two summary counts of public drunkenness and disregarding traffic lanes. The charges were filed by state Trooper Tyler Arbogast, of the Milton State Police Barracks, in the Mifflinburg office of District Judge Jeffrey Mensh.

Police were dispatched at 6:50 p.m. Nov. 6 to a residence on Strawbridge Road in Buffalo Township for a report of a red Chevrolet Silverado driven into a yard. The witness said the driver, later identified as Spicey, allegedly exited the vehicle and started urinating on the side of the road, police said.

Spivey told police he was traveling home from work. Police said he allegedly smelled like alcohol and marijuana and showed signs of impairment.

Spivey denied the accusations and allegedly failed field sobriety tests. He was initially allegedly found with three marijuana smoking devices and later with a small bag of marijuana hidden in his sock, police said.

While being transported to Evangelical Community Hospital, Spivey allegedly began yelling in the back of the patrol car. After verbally agreeing to blood draws, Spivey allegedly continued yelling, saying profanities and then revoked his consent. He was then escorted out of the hospital and into a patrol car, police said.

While at the state police headquarters, Spivey allegedly intentionally urinated within the holding cell. While doing so, Spivey allegedly exposed himself to two troopers, police said.

Spivey was arraigned in front of Mensh on Nov. 6 and committed as a Union County inmate in lieu of $15,000 cash bail. He is scheduled for a preliminary hearing in front of Mensh at 2 p.m. Nov. 28.

Spivey was previously charged with four felonies: one count each of rape, and burglary; and four misdemeanors: one count each of terroristic threats, indecent assault and simple assault.

Police reported that Spivey raped a woman in her apartment on April 27. Before he left, he allegedly threatened to come back and perform more sexual acts against her, police said.

Spivey has been free after posting $50,000 cash bail on June 15 through professional surety David R. Morgan. He is scheduled for jury selection at 9 a.m. Jan. 29 in front of Union County Judge Michael Piecuch.
