Police: Wichita Falls attorney said, 'She needed to be smeared,' after posting flyers

Police say a Wichita Falls attorney arrested three times this month violated a protective order by posting flyers about his ex-girlfriend at an establishment billing itself as the oldest bar in Wichita Falls and other downtown buildings, according to allegations in court records.

Dean Colin Godfrey, 34, taped the flyers up Saturday while his court-ordered GPS ankle monitor's battery was dead, violating bond conditions for him to wear a functioning monitor, according to allegations in a police affidavit.

After Godfrey was arrested Sunday he told his mother in a jailhouse telephone call: "I'm actually kind of excited about this. I mean, she needed to be smeared," according to allegations in the affidavit.

Godfrey laughed, adding: "There's 5,000 of those things. They're everywhere. . . . They'll find them for weeks," according to allegations in the affidavit.

The day before he allegedly posted the flyers, Godfrey contacted the Times Record News, saying there are two sides to every story, and he wanted to set the record straight that he is not a stalker.

"I've made some mistakes just like she made some mistakes, and that's kind of how couples are," he said in a telephone interview Friday.

Attempts to reach his defense attorney, Chuck Smith, have been unsuccessful.

Now in private practice, Godfrey is a former Wichita County assistant district attorney under a previous DA's administration.

He was being held on a $20,000 bond Wednesday in the Wichita County Law Enforcement Center for a felony charge of repeatedly violating certain court orders and bond conditions within 12 months, according to court and jail records.

Godfrey was also being held without bond on a felony stalking charge, according to court records. He is accused of showing up at his ex-girlfriend's workplace May 8, repeatedly contacting her and hijacking her social media and email accounts.

In addition, he is charged with misdemeanor criminal trespass in connection with an April 29 incident in which he allegedly went to his girlfriend's home, which he is barred from, according to allegations in court documents.

A Wichita Falls police affidavit detailed allegations that he violated a protective order and bond conditions for the stalking charge that required the GPS ankle monitor.

A detective learned this week that officers filed nine reports about Godfrey in connection with the accusations, according to allegations in court documents.

The reports all said that at about 6 p.m. Saturday, officers were dispatched to P2-The Deuce in the 1400 block of Lamar Boulevard to investigate, and the co-owner of Bohn & Bohn Associates wanted to make a report on behalf of Godfrey's ex-girlfriend, according to allegations.

The co-owner has been providing security for the victim because Godfrey has been committing criminal acts against her, according to allegations. Officers knew about the temporary protective order granted to the victim on May 9 for 20 days.

The co-owner of the private investigation agency told police she received a call from an unknown person at The Deuce, who told her there were flyers with the victim's photo on them on the building, according to allegations in the affidavit.

She saw the flyers, herself, when she came to the bar and restaurant, according to allegations in the affidavit. Officers walked around the outside of the bar and found more flyers taped up.

Apparently printed out and stuck to the side of the buildings, they included a variety of flyers with email threads, Snapchat threads and other electronic messages, according to allegations in the affidavit.

Most of the flyers were about an incident already reported that happened while Godfrey and his ex-girlfriend were still dating, according to allegations. She had permission to be at his residence at the time.

The flyer has photos of her climbing a fence and using a doorway to enter and leave his home, according to allegations. A message on the bottom of the flyer says: “WHO IS STALKING WHO?”

Another flyer appears be an email thread from Godfrey's ex-girlfriend to him, saying, "I'm sorry," according to allegations in court documents. At the bottom of the flyer is a statement: " 'VICTIM' VIOLATING HER OWN PROTECTIVE ORDER. . . . Why? Because she doesn't actually want it."

But the electronic message can't be from the victim because she has been unable to access her email since Godfrey locked her out of it, according to allegations in court records. Police found more flyers scattered in the parking lot nearby.

The bar owner told officers that when employees left around 1 a.m. Saturday, the flyers were not there, but a worker noticed them on the building around 3 p.m. later that day, according to allegations in court records.

The ex-girlfriend's attorney arrived and told police she had seen many more flyers posted on signs and buildings around downtown, and officers took more reports as they were found, according to allegations in court documents.

The officers stated they believe Godfrey posted the flyers because he was upset about being arrested previously in connection with reports his ex-girlfriend made against him, according to allegations in court records. Plus, only Godfrey had access to the photos, emails and Snapchat threads.

The Wichita County Community Supervision and Corrections Department was alerted that Godfrey did not charge the battery on his GPS ankle monitor Saturday, according to allegations in court records. The department repeatedly tried to get in touch with him to tell him to charge it between 8:30 p.m. and 9:30 p.m. that day. He did not respond.

The department couldn't locate Godfrey at 10:08 p.m. Saturday through the monitor, according to allegations in court records. The monitoring company verified Godfrey couldn't be located at 10:24 p.m.

At 1:51 a.m. Sunday, police went to the home of Godfrey's parents to arrest him because of the ankle monitor, according to allegations. Officers saw him through a window, and he closed the shades and refused to answer the door.

His parents allowed police to come inside and arrest Godfrey, according to allegations in court documents. He is to be held in jail until an appropriate bond is set for the stalking charge.
