Poughkeepsie man shot, then arrested charged with menacing, weapon possession

A 37-year-old man, who was shot by an officer Sunday after Poughkeepsie city police said the man removed a semi-automatic handgun from his pocket and menaced an officer, has been charged with felony menacing and felony second-degree criminal possession of a weapon.

Leopoldo Duartepalacios was remanded to Dutchess County Jail at arraignment, a police statement said.

At about 7:48 p.m. on Sunday, dispatchers received a report of a man with a gun on Main Street. The police said that at about 7:53 p.m., officers were sent and found a person the police said fit the description.

The police said officers verbally engaged with the person to de-escalate the situation, but the man then removed a Keltec 9mm semi-automatic handgun and menaced one of the officers, according to police.

The police said that after an officer fired his service weapon, striking Duartepalacios, officers handcuffed Duartepalacios and began immediate first-aid measures, including applying multiple tourniquets, and requested an ambulance.

The suspect was treated and released from a hospital, police said.

The officers involved were taken to a hospital for observation, evaluation and treatment and were released.
