Prosecutors charge the driver from March's shooting at Walmart

LAFAYETTE, Ind. — Emily Ellison drove Cade Monroe Davies-Gaeta to the West Lafayette Walmart on March 19, where Davies-Gaeta shot Gabriel Padgett in a botched robbery, according to prosecutors who charged Ellison on Thursday.

Prosecutors also filed seven new counts against Davies-Gaeta on Thursday.

Ellison admitted to driving Davies-Gaeta, 18, and his younger brother, along with an uncharged woman, to the Walmart parking lot, according to prosecutors. Just before Padgett got into the car to buy a Glock handgun, Davies-Gaeta and his brother put on ski masks.

When Padgett got into the sports utility vehicle that Ellison was driving, Davies-Gaeta tried to rob him at gunpoint, according to prosecutors. Padgett got out and tried to run away, but Ellison said Davies-Gaeta shot Padgett, according to prosecutors.

Ellison drove away from the scene, eventually ditching the borrowed SUV in Oxford and catching a ride to a friend's house near Rochester, where police arrested Davies-Gaeta the next morning.

On Thursday, prosecutors charged Ellison, 24, of the 500 block of Northchester Lane in Lafayette, with attempted robbery resulting in serious bodily injury, attempted armed robbery, attempted theft.

Ellison also pleaded guilty in June in Tippecanoe Superior 2, where she faced two counts of intimidation with a deadly weapon, criminal recklessness with a deadly weapon, invasion of privacy. She will be sentenced Monday.

Ellison also has a theft charge pending in Tippecanoe Superior 5. He trial in that case is scheduled for Oct. 5.

She was convicted in May of possession of meth in Benton County.

Prosecutors also amended Davies-Gaeta's charges, which now are attempted robbery resulting in serious bodily injury, attempted armed robbery, battery with a deadly weapon and battery with serious bodily injury, criminal recklessness and attempted theft.

Both Ellison and Davies-Gaeta are charged with contributing to the delinquency of a minor for involving Davies-Gaeta's 14-year-old brother, who pleaded guilty in May to conspiracy to commit armed robbery resulting in serious bodily injury, which would be a Level 2 felony if committed by an adult, according to prosecutors.

Davies-Gaeta remains incarcerated at the Tippecanoe County Jail, according to online jail records.

Ellison does not appear on the Tippecanoe County Jail's list of current inmates, according to online jail records.
