Purdue dismissed from lawsuit alleging star player spread herpes

LAFAYETTE, Ind. — Alyssa Chambers' lawsuit against Purdue University and Isaac Haas, its former star basketball player, is over.

Chambers filed suit on April 10, 2018, accusing Haas of intentionally infecting her with herpes during consensual sexual encounters in May 2017.

Haas settled with Chambers in March.

On Oct. 26, a court order of summary judgment dismissed Purdue University from Chambers' lawsuit, ending the four-year drama that broke in April 2018.

Chambers' lawsuit originally asked for $1 million in damages and claimed that Haas lied about having herpes during discussions before he and Chambers had sex.

The Oct. 26 summary order states, "Purdue rehashes its argument that Chamber's claim must be denied because it wasn't brought under the Medical Malpractice Act.

"This argument would have merit if Chambers alleged that Purdue's healthcare providers, alone, created and implemented such a policy. However, this is not the case. Chambers alleges personnel in the athletic department, who were not healthcare providers, created and implemented a no-test STD policy in concert with Purdue's healthcare providers, to assist student athletes with recruitment and ensure they remain eligible for games.

"Purdue argues that, as a matter of law, it does not have a common law duty to protect its students from being infected with STDs," the order states.

"Purdue has shown there are no genuine issues of material fact and they have negated the element of causation. Plaintiff has not demonstrated the existence of any genuine issue of material fact. Accordingly, the Court grants summary judgment in favor of Purdue on the remaining claim," the order states.

Purdue University was the last defendant dismissed from the lawsuit.

On March 17, Chambers and Haas' attorneys filed a stipulation for a motion to dismiss. Tippecanoe Circuit Judge Sean Persin signed dismissal order on March 22.

“There was a confidential non-disclosure agreement between the parties," said Haas' attorney, Brian Walker of Ball Eggleston, when asked in April about Haas' dismissal and any agreements between the parties.

Haas' one-time girlfriend, Madison Millsaps, was dismissed from the lawsuit in 2018.
