Rape charge against Dennis man dropped

BARNSTABLE — Criminal charges from 2019, including rape of a child and indecent assault and battery on a child, filed against Kenneth Ellis, 50, of Dennis were dropped on July 15 in Barnstable Superior Court.

Ellis was arrested in Dennis in 2019 and indicted the same year on one charge of aggravated rape of a child with at least a 10-year age difference and three charges of indecent assault and battery on a child under 14.

The alleged victim was living in West Dennis at the time of the reported incident.

On July 15, prosecutors filed a nolle prosequi with each of the four charges, leading to the dismissal of the case, according to the court docket.

The charges against Ellis were dismissed because of the alleged victim's inability to testify due to the person's mental health state, and the unavailability of mental health resources for them, according to the docket.
