Records: Slaying victim was frequent trespasser
Aug. 8—The woman who shot and killed an alleged trespasser at her home on Friday was in the process of obtaining a restraining order against the man, police said Tuesday.
Javier Jimenez, 39, had been accused of trespassing on the property in the 700 block of Dawn Loop multiple times, court records show.
Records show Jimenez was picked up by police at least twice in May last year on suspicion of criminal trespass charges at the same address.
Most recently Jimenez had been booked into the Curry County Adult Detention Center on the charge on May 15, 2022, and released on bond May 23, 2022. Court records also show he was arrested on the same charge May 6, 2022, and released May 9 of that year.
Police said the woman who lives at the address called 911 prior to the shooting to report a burglary in progress. Police said Jimenez was dead when they arrived at the scene.
The woman was detained and questioned by police on Friday morning, but no charges were immediately filed. "We're still awaiting autopsy results and deciding whether to take it to a grand jury," Police Lt. Steven Wright said on Saturday.
Capt. Robert Telles on Monday said preliminary autopsy results still were not available and no decision had been made on whether to charge the woman.
Telles said he did not know if the woman had any kind of relationship with Jimenez "other than I guess just knowing each other."
It wasn't immediately clear on Tuesday what steps the woman had taken to secure a restraining order against Jimenez.
Police have so far declined to disclose details about what happened Friday that led to the shooting and why Jimenez continued to return to the property.
A criminal complaint filed May 16, 2022, reported a caller complained Jimenez was on the Dawn Loop property and had just left. The responding officer wrote in the report he had dealt with Jimenez "multiple times in reference to this trespass. I issued the trespass to him at the beginning of the month and have arrested Javier due to trespass the week prior."
It wasn't clear if Javier had been on the property between May of 2022 and Friday. Online court records show he was due in court June 14, 2022, to face a trespassing charge but it's not clear whether he appeared in court.
A police news release issued last week stated officers were dispatched about 10 a.m. Friday for a burglary in progress. "The caller told dispatch a male had broken into their house. Officers arrived on scene and discovered a male had been shot and succumbed to his injuries," the release stated.
Wright said the shooting occurred "kind of in the middle" of the house. The victim and shooter were believed to be the only witnesses to the incident, Wright said.
The region's Major Crimes Unit was activated to investigate the case.
The slaying marks Clovis' seventh homicide this year and its fourth since June 19.
