Semi-truck driver accused in deadly I-5 crash to stand trial for drug possession

PORTLAND, Ore. (KOIN) – The man police say crashed a semi-truck into a loaded van on Interstate 5 last year, killing seven people, will also stand trial for possessing drugs at the time of the crash.

An Oregon judge has denied a request made by Lincoln Smith’s lawyer to suppress evidence of the drugs found in the former truck driver’s possession while he was recovering in a hospital after the accident.

According to the judge’s order, the motion was denied “based on findings of fact and conclusions” shared previously, and the evidence will be used when he returns for his next court date.

Last May, a grand jury indicted Smith, 53, on seven counts of manslaughter, driving under the influence of intoxicants and reckless driving.

Oregon State Police say Smith was driving a semi-truck under the influence on May 18 when he went off the shoulder of the highway, hitting a Ford Econoline van with 11 passengers inside and pushing the van into another parked vehicle.

Crash on US-30 in NW Portland causes 2-hour traffic delay

Six passengers in the van were declared dead at the scene, and one passenger died later in a local hospital. Four other injured occupants were transported for medical care.

Attorneys say Smith, from North Highlands, Calif., admitted in court to using speed the day before the crash. Investigators say they found multiple containers of inhalants inside the truck and a container of meth on Smith from the scene.
