New sentencing date set for Jessy Kurczewski in Waukesha eye drops homicide trial

The sentencing of Jessy Kurczewski, the Franklin woman convicted of killing her friend with eye drops, is set for 9 a.m. Friday, April 5.

Kurczewski, who was also convicted of two felony theft charges, faces mandatory life in prison for the homicide charge while the felony theft counts each carry a maximum of five years in prison.

Sentencing was originally scheduled for Dec. 7, 2023, but was delayed after Kurczewski’s two attorneys, Pablo Galaviz and Donna Kuchler, both requested to withdraw from the case over possible conflicts of interest. Waukesha County Circuit Court Judge Jennifer Dorow granted both requests.

Jessy Kurczewski enters the courtroom on Dec. 7, 2023 where her lawyers Donna Kuchler and Pablo Galaviz would be allowed to withdraw as counsel for Kurczewski due to conflict of interest. Her sentencing hearing is scheduled for April 5, 2024.

During a status conference on Jan. 12, two attorneys appointed to replace Galaviz and Kuchler also requested to be withdrawn from the case, according to online court documents. With no objection from Kurczewski, the court granted their withdrawals as well.

Since June 2021, eight attorneys have withdrawn from representing Kurczewski, records show.

Attorney Russell J. A. Jones accepted appointment as Kurczewski’s newest attorney.

On Nov. 14, 2023, Kurczewski, 39, was convicted of first-degree intentional homicide of Lynn Hernan, a friend whom she’d been caring for, by putting eye drops into bottled water in October 2018.

Kurczewski was also convicted of two counts of theft of movable property less than $100,000 but more than $10,000 for stealing from Hernan.
