Shelby restaurant inspections: August and September critical violations

The following restaurant inspections with critical violations were conducted by the Shelby City Health Department in August and September:

Legends Sports Grill & Pub, 63 W. Main St., Shelby, Aug. 22. Chlorine sanitizing solution at incorrect temperature and/or concentration (critical repeat). Observed no sanitizing solution in dishwasher. Hand sanitize in three-compartment sink until repaired.Correct by Aug. 26.

Diner 39, 180 Mansfield Ave., Shelby, Sept. 1. Person in charge (PIC) unable to demonstrate knowledge by having no critical violations (critical repeat). Correct immediately. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical repeat, corrected during inspection). Observed no date marking on TCS foods in facility. To prevent a foodborne illness TCS foods shall be marked to indicate the date by which the food shall be consumed per the code.

Shelby IGA Express, 147½ Mansfield Ave., Shelby, Sept. 2. Missing and/or incomplete allergen declaration(s) (critical, corrected during inspection). Observed subs and pizza subs with no ingredient information and no allergen information. Remove from service and provide proper labeling. Correct immediately.

Ted & Ali's Café LLC, 69 N. Gamble St., Shelby, Sept. 7. Chlorine sanitizing solution at incorrect temperature and/or concentration (critical, corrected during inspection). Observed no sanitizer in three-compartment sink or wipe buckets. Facility was using a soap that they thought had a sanitizer in it. Food from unapproved source not discarded (critical). Observed homemade salsa in the Pepsi counter top cold holding unit. To prevent a poisoning or foodborne illness, all foods shall be from an approved source. Remove from unit and, if for personal use, store in a unit and label for personal use only. Owner removed & placed in area for personal use.

China House, 215 Mansfield Ave., Shelby, Sept. 15. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical, corrected during inspection). No date marking on TCS foods. To prevent the growth of pathogens which could cause a foodborne illness, all TCS foods shall be date marked to indicate the date the food shall be consumed or discarded by. This is a repeat violation and one more will require an office hearing.

The Vault Wine Bar, 29 W. Main St., Shelby, Sept. 16. Presence of live insects, rodents, and other pests (critical, corrected during inspection). Observed house flies in the facility. To prevent a foodborne illness from contamination, remove pests and keep outer door with damaged screen shut.

Shelby Pre K- 8 School, 109 W. Smiley Ave., Shelby, Sept. 20. Working containers of poisonous or toxic materials not properly labeled (critical, corrected during inspection). Observed container that is labeled ranch in dishroom for three-compartment sink and appears to be soap. Label correctly so a chemical poisoning does not occur. Observed sanitizer buckets with no sanitizer. Employees changed to a detergent bucket and used a spray sanitizer.
