Suspect arrested after stand-off, previously arrested on charges of rape, sodomy, incest

Jan. 25—A Waco man was arrested on several charges after a stand-off with the RPD.

Errich S. Schmidt, Waco, was arrested on Jan. 22 and charged with first-degree burglary, first-degree robbery, first-degree terroristic threatening, first-degree wanton endangerment, fourth-degree assault, the possession of a handgun by a convicted felon, resisting arrest, and theft of a legend drug.

According to an arrest citation, Schmidt forced his way into a residence by kicking in the front door, damaging the lock mechanism in the process.

Allegedly, a knife-wielding Schmidt went into an upstairs bedroom occupied by three people — one of whom was in possession of a 9mm Taurus handgun. A physical altercation allegedly occurred between Schmidt and the person with the handgun.

Schmidt allegedly caused a wrist injury to the person before taking their handgun. The pistol was allegedly fired in the struggle, with the bullet passing through the bedroom wall into the bathroom and up the ceiling. Witnesses claimed that Schmidt stood in the doorway of the room for several seconds before stealing some medicine and exiting the residence with the stolen handgun.

The three subjects then contacted the Richmond Police Department, at which time Schmidt allegedly began facetiming one of the three.

According to the citation, Schmidt told the person on the other line that he was going to the residence of one of the victims and was going to kill them.

Officers asked where Schmidt was located, and he allegedly stated that he was coming to the residence with the handgun to use it on the occupants. While the officers were still investigating, Schmidt arrived on the scene. When the officers made contact with him, he allegedly refused to leave his vehicle.

While the officers acknowledged the handgun in his lap, Schmidt did not brandish it during the confrontation. During negotiations, Schmidt allegedly acknowledged to breaking into the residence with the knife and stealing and discharging the handgun.

After a few hours of negotiation, Schmidt allegedly exited the vehicle and and was detained without incident. Upon searching the vehicle, the alleged stolen Taurus pistol was found.

After speaking with one of the residents, Schmidt acknowledged voice males he with threatening comments towards said resident.

Schmidt was allegedly found to be a convicted felon after a background check was run. He was allegedly uncooperative once taken to the RPD — making multiple attempts to harm himself. Due to the alleged behavior, police were unable to interrogate him.

An article detailing Schmidt's felony arrest in 2016 states that he was arrested alongside one Donald Gene Pancake of Irvine.

Schmidt was allegedly indicted on 64 counts — 20 counts of first-degree rape, 11 counts of first-degree sodomy, 31 counts of incest, first-degree sexual abuse, and the use of an electronic device to procure a minor for sex.
