Tioga County NY man indicted on 6 counts following Erin police chase

ERIN, N.Y. (WETM) — A Tioga County NY man was indicted on six criminal counts by a Chemung County Grand Jury after police say a chase in Chemung County led to the discovery of a rifle and drugs.

According to the indictment, 25-year-old Austin Elia of Willseyville was seen in court on Jan. 25 and indicted on six charges of drug possession, illegal weapons, and eluding police after his arrest on Jan. 20.

Elia was indicted on the charge of criminal possession of a controlled substance in the third degree for possession of meth of at least one-eight ounce or more.

The indictment claims that counts two, three, four, and five all relate to weapons charges, one criminal possession of a weapon in the second degree, and three criminal possession of a weapon charges in the third degree.

The charges claim that Elia had a Romanian WASR-10 AK-47 rifle in his possession at the time of his arrest with two magazines capable of holding 20 and 30 rounds.

The sixth count in the indictment is on the charge of unlawful fleeing a police officer in a motor vehicle in the third degree.

The indictment claims that Elia failed to stop his car at a stop sign on Red Chalk Road in the Town of Erin and then failed to pull over for a police officer with lights and sirens active. The document says that Elia tried to elude New York State Police by going over 100mph on state Route 224 in the Village of Van Etten.
