Two seek Fourth District Supreme Court seat

Oct. 31—ELIZABETHTOWN — Two candidates are vying for one open seat on State Supreme Court in the Fourth Judicial District in the general election.

Supreme Court Justice Michael Cuevas is reaching mandatory retirement age, and Paul Davenport of Glenville and Carl G. Falotico of Schenectady are running for his seat.

Davenport (R-C) is an attorney with Whiteman Osterman & Hanna in Albany.

Davenport, 61, is also an acting Schenectady City Court judge and has been a Town of Glenville town justice for 16 years.

He and his wife, Julie, have three grown children: Shawna, Brian, and Michael.

Falotico (D) is a Schenectady City Court judge who has been on the bench for four years. He was previously Schenectady city attorney in charge of legal affairs. He's also been a Schenectady County assistant district attorney.

Falotico, 40, lives in Schenectady with his wife, Jackie, and their two children.

The Fourth Judicial District covers Clinton, Essex, Franklin, Fulton, Hamilton, Montgomery, Saratoga, Schenectady, St. Lawrence, Warren and Washington counties.

State Supreme Court Justice Michael Cuevas of Schenectady will reach the state's mandatory retirement age of 70 this year. Cuevas has applied for a two-year extension to allow him to serve as an adjunct justice.

The winner on Nov. 7 will receive a 14-year term on the court.
