Woman suing after renting a car in Las Vegas: ‘I would not rent a car again … never’

LAS VEGAS (KLAS) — Danielle Brissett sat in jail for six days in August of 2023 after being arrested in front of her children. It happened after Enterprise Rent-A-Car reported the Kia Sedona she rented in 2016 was stolen.

Now Brissett is suing the car rental company.

“It was horrible, it was degrading, it was depressing,” Brissett said. “I felt intimated. I was surrounded by a number of police officers and I had two my children with me, my 1-year-old and 15-year-old son.”

According to the lawsuit she had rented the vehicle on Oct. 3, 2016, to move her family from Las Vegas to Pittsburgh. But on Oct. 9, 2016, she called to extend her rental until Nov. 1, 2016.

According to the lawsuit, an employee of Enterprise Rent-A-Car named Doug told her to return it by the new date and put the keys under the front seat. She did just that and returned the rental on Oct. 31, 2016, a day before the rental was up.

That didn’t stop a criminal complaint being filed in Nevada on Dec. 9, 2016, alleging a felony charge against her for embezzling a rental vehicle on Aug. 5, 2016, which was more than two months before she even had rented it.

On Feb. 23, 2017, she received an email confirming she had returned the vehicle.

Fast forward seven years, when she was pulled over for a minor traffic infraction. That’s where she found there was a warrant out for her from Nevada. She was arrested in front of her children. “Now I have these charges that still exist and even though the charges are dismissed they are not gone,” she said.

“But what is more egregious is that after we filed this lawsuit, they recently — just three days ago — sent a letter to Danielle saying, hey, you damaged this vehicle. Report to your insurance or send us your credit card. It is compounding issues upon issues,” according to her attorney, Christian Morris.

“I would not rent a car again … never,” Brissett said.

Enterprise Rent-A-Car responded to 8 News Now request for comment telling us they are unable to provide details or comment on pending litigation.

Brissett’s lawyers are looking for others that may have had the same thing happen to them.

Experts advise people car rental customers to always hand the keys to an agent and get a receipt. If the office is closed, look for a drop box with the company logo on it. Always inspect the vehicle and take pictures before and after. And save all correspondence like emails from the rental company.
