Worthington man to serve 23 months in prison for assault

Apr. 3—WORTHINGTON — A local resident will spend just shy of two years in prison for a criminal conviction relating to an assault that occurred at the Red Carpet Inn in September 2020.

Ath Xayachack, 59, was arrested after a victim reported that he punched and kicked them and threatened them with a knife. He was charged with three felony offenses — second-degree assault with a dangerous weapon, threats of violence and domestic assault by strangulation — and two counts of misdemeanor domestic assault.

In February, Xayachack pleaded guilty to the felony assault charge; the other charges were dismissed as part of the plea agreement. His sentencing hearing was Tuesday afternoon.

Fifth Judicial District Judge Sherry Haley explained that the presumptive, or usual, sentence based on Xayachack's criminal history was 27 months in prison, with a range of 23 to 32 months. The parties agreed on the minimum recommended sentence of 23 months. Xayachack was also given credit for 198 days already served in jail.
