Lauren Boebert drops restraining order against ex-husband after 'strict' agreement

Rep. Lauren Boebert has withdrawn her request for a temporary restraining order against her ex-husband in a Colorado courtroom, according to multiple reports.

During the court hearing in Rifle, the Colorado Republican asked Garfield County Judge Jonathan Pototsky to throw out the order she requested on Feb. 5 against her 43-year-old ex-husband, Jayson Boebert, reported the Glenwood Springs Post Independent.

Boebert told Pototsky that the estranged couple had come to a “strict” agreement that she hopes her ex-husband will follow, according to the outlet.

The session on Monday was supposed to happen two separate times, but Jayson Boebert's failure to appear led to delays, CBS News reported.

Two prior incidents in January may have prompted Boebert's restraining order request

Two incidents in January involving Boebert's ex-husband occurred a month before the 37-year-old requested a restraining order.

The first, on Jan. 6, occurred at a local restaurant in Glenwood Springs and led to police responding to a report of "domestic violence abuse," according to court papers obtained by USA TODAY.

Boebert called 911, identified herself and the dispatcher heard her say, "I just touched your nose," an affidavit shows. Jayson Boebert claimed his ex-wife punched him in the face, according to court records.

When officers arrived at the restaurant, Lauren Boebert told them she had alcoholic drinks with her ex-husband and they discussed their current partners, court documents show. The incident ended with police not finding any evidence of abuse and escorting Jayson Boebert out while he told officers to "investigate his ex-wife for DUI," the records continued.

The next incident happened Jan. 9 at the Boeberts' home and involved Jayson Boebert and the estranged couple's 18-year-old son, Tyler Boebert, the Post Independent reported.

According to the arrest affidavit, a relative called 911 to report that Jason Boebert got angry, threw his phone across the house, pushed him to the ground and shoved his thumb into his mouth. The court papers also say that Jayson Boebert was armed with a rifle and was intoxicated during the incident.

"The argument started over laying down to sleep," an officer wrote in the court documents.

The altercation resulted in Jayson being arrested and being charged with third-degree assault, harassment and prohibited use of a weapon, the outlet said.

Boebert's ex-husband is also facing disorderly conduct and obstruction of a peace officer charges stemming from the January incidents, according to court documents.

A message left by USA TODAY at the law firm representing Jayson Boebert was not immediately returned Tuesday.

Protection order in place during Tyler Boebert's criminal case

The court session ending the restraining order came two weeks after Tyler Boebert was charged with 22 counts altogether, five of which are felonies, according to Garfield County jail records.

The 18-year-old was picked up Feb. 27 after Rifle police received reports about a string of recent vehicle trespassing incidents and property thefts in the area, the department said in a Facebook post.

"I love my son Tyler, who has been through some very difficult, public challenges for a young man and the subject of attention that he didn't ask for. It breaks my heart to see my child struggling and, in this situation, especially when he has been provided multiple opportunities to get his life on track," Lauren Boebert said in an emailed statement. "As an adult and father, Tyler will take responsibility for his actions and should be held accountable for poor decisions just like any other citizen."

The district attorney's office implemented a new protection order Monday that bars Jayson Boebert from possessing guns or consuming alcohol and drugs during his son's case, the Post Independent reported.

The order does not prohibit contact with his son, Jayson Boebert's defense attorney told the outlet. He is scheduled to return to court on April 15 as legal proceedings continue.
