A survivor of Kodak Center attack released from hospital

A person hurt in the Kodak Center attack has been released from the hospital, police said.

The driver of the Mitsubishi Outlander caught up in the fatal New Year's Day crash has been released from Rochester General Hospital after suffering injuries that were not considered life-threatening, according to Rochester Police Chief Greg Bello. The driver's identity has not been released.

Three people lost their lives and at least nine others sustained injuries in a collision that occurred outside the Kodak Center on West Ridge Road in Rochester during the early morning hours of New Year's Day after a concert.

Michael Avery, a 35-year-old from Syracuse, was behind the wheel of a Ford Expedition traveling east, according to police. Deliberately accelerating, he crossed the westbound lane and collided with the smaller Mitsubishi as it exited the Kodak Center parking lot.

Two people, Justina Hughes, 28, of Geneva and Joshua Orr, 29, of Webster, died at the scene.
